McGartland & Borchardt LLP is now accepting DePuy Hip Recall cases. DePuy Orthaepedics issued a voluntary recall of the company’s ASR™ XL Acetabular Hip System in August of 2010. The ASR has a complete metal-on-metal design making the implant different from most.
DePuy Orthaepedics, a subsidiary of Johnson & Johnson, one of the world’s largest pharmaceutical and medical companies, released their first ASR system in July of 2003. Between July 2003 and August 2010, an estimated 93,000 patients were treated with the ASR system. After hundreds of complaints and revision surgeries, the FDA (Food and Drug Administration) looked more closely into the ASR system. After nine years of allowing the ASR to be used, researchers found the model to have much more severe side effects than DePuy hoped for.
Studies done by the National Joint Registry for England and Wales found that the design of the metal-on-metal hip replacement system is prone to releasing tiny shavings of cobalt and chromium into the tissue and circulatory system, increasing the risk of permanent body cell and tissue damage. Many patients with the ASR suffer from constant pain, swelling and problems walking, even after several revision surgeries. An estimated 25,000 ASR patients have undergone costly revision surgeries but have yet to see a positive outcome. The majority are still suffering from serious complications. These symptoms can be severe enough to alter a person’s life. Patients should not have to live with constant pain, nor should they continue to have multiple expensive surgeries that end with negative results. Johnson & Johnson is facing hundreds of lawsuits, and most likely has more to come. Patients who have received a DePuy ASR Hip System are encouraged to speak with their doctors about any symptoms they might have, and to contact a lawyer regarding any legal compensation options.
